going to steve paulson. >> very good morning. very clear cold morning . temperatures at 30s and 40s. little warmer in san francisco. low 50s there. 37 santa rosa. 38 napa. and a couple on the peninsula. san francisco been warming it up everyday this week a little bit. a little jump yesterday. 66 today. clear skies today and tomorrow. we get a slight off shore component. sunny and warm but the days aren't long any more. overall highs 70s. 60s to near 70s around the bay. here's sal. >> traffic is getting busier if you are driving on the bridges, for example, trying to get across the bay bridge. that is about a 20 minute delay. nothing too severe. 20 minute delay if you are in the fast traet rak lane.

the -- fastrak lane. really it's much quicker. this is a look at san francisco northbound and southbound 101. traffic is busy. 101 is a little slow there or congested. southbound 680 is going to be slow. let's go back to the desk. >> thank you, sal. police are investigating a dog attack that injured four people in the middle of a neighborhood. tara moriarty has been talking to neighbors all morning. she's learned new information about what unfolded. and tara joins us now live. good morning. >> reporter: good morning. a neighbor says he saw part of the attack. and he believes that the dogs in questions were pit bulls or pit bull mixes. he was walking down the trail when these two dogs lunged at them. happened south of bellflower.

neighbors ran out of their homes and the dogs turned on them. four people in all were hurt. some were taken away by ambulance. others drove themselves to the hospital to be treated for wounds. >> officers arrived and the dogs charged at the officers and the officers forced to fire upon the officers killing one. the other ran away. >> police captured the dog when it returned an hour and a half later. no word on where the dog's owners are. this is all part of the police investigation. we have put in a call to police. and meantime, the dogs are being tested for rabies. tara moriarty, ktvu channel 2 news. >> time is 7:04. a 20-year-old school employee is accused of inappropriately touching and kissing a girl.

brian flores, what are police saying about this case? >> reporter: well, dave, good morning. police are saying the alleged incident happened a couple weeks ago. the person involved is a 20-year-old child care aid here in san mateo. police say the arrested erik michael rants at home for allegedly kissing and groping the girl that attends the after-school program here at the school. the incident happened on friday october 18th according to a joint press release. police say they received a referral about the alleged incident the following monday and police removed rants from any contact with kids. after interviewing the victim, they found probable cause the make the arrest. from what we understand, parents were notified yesterday through email and hard copied letters. meetings are scheduled to take

place to meet with parents but we don't know when that is. the district and police are working to see if other kids may have been impacted. the arraignment scheduled for december 5th. brian flores, ktvu, channel 2 news. >> 7:05. later today, a man accused of attempted robbery who was shot and wounded sunday by san francisco police is due in court. 19-year-old navarez is accused of attacking a man in the marina district. he went on craigslist and arranged to buy an iphone and then tried to rob him. he was shot and fired what turned out to be blanks. police held a town hall meeting to address the concerns of residents. >> this is frightening, i must say. you don't expect something like this to happen middle of the dachlt

>> police released a photo they say holding a gun. facing similar charges in san mateo countsy. >> later today a public memorial service will be held for a couple hit and killed by a suspected drunk driver. hit and killed last thursday as they walked their dogs. 53-year-old margerie is facing are charges. her arraignment has been postponed three times because she's not been medically cleared by the jail to be there. that court appearance has been rescheduled for this afternoon. last night, passengers on a delta airline's flight from tokyo to san francisco finally arrived at sfo but not before they made an emergency landing in alaska in a remote area. diverted to the alutian islands.

the pilots acted out of caution. the plane carried 167 passengers and 11 crew. that's almost double the population of the little town of cold bay where they had to land. a second plane was sent over there to take everyone to sfo. >> 7:07. dozens of students are recovering from food poisoning. there are about 40 cases with four students now hospitalized. the students reportedly became sick after eating at the student housing complex called florence moor hall. the dining staff are sanitizing the areas. faculty members of city college in san francisco say complicated contract negotiations. they've been fighting to recover what they lost in two separate pay cuts over the past year. in july, the accrediting commission announced plans to pull city

college's accreditation next summer. the possible closure means the union has little bargaining power. a spokes person says the school is currently in mediation with the union. >> time now 7:08. explosion last night injured a child and also burned someone else. a small gas canister used to cook food exploded. happened while people were cooking food by a student group. police told the daily cow a 10 year old complained of having back pain. and an adult suffered minor burns on the arm. an apartment building in berkeley that was destroyed in a fire last year will remain rent controlled. there was some concern the landlord would tear down the property and replace it with higher rent housing. the landlord will rebuild the burned out units but maintain rent

control status. >> the san francisco chronicle is joining us a growing number of newspapers in a growing controversy. the conical will stop using the term redskins. decided to eliminate the term because of a long-standing policy against using racial slurs. the chronicle considers redskins a patently racist term. requesting a meeting with nfl owners during superbowl week. hopes this will put pressure on the team to change the name. a home burglary case yesterday morning. police pulled over wells for a moving violation. someone had broken into a house and stolen $5,000 worth of july ree.

gate. we're taking a live look at this press conference which just started about five minutes ago. this is faa administrator. the timing of these rules will be up to individual airlines. the faa says connections to the internet are not going to be allowed below 10,000 feet and prior to today, passengers were not allowed to use portable electronic devices during take off and landing because they were studying whether the signals interfered. delayed the partial government shut down for not releasing this information sooner. i will continue monitoring this news conference. for more information on these rules being used during taxi, take off, landing, mid flight and have you dates for you at 8:15. ktvu, channel 2 news. >> 7:16. new this morning,

federal prosecutors are expected to recommend whether to seek the death penalty against boston bomber suspect. a federal judge recently rejected a defense motion that was seeking more time to prepare a presentation opposing the death penalty. >> 7:16. a judge says pg&e should be fined $7 million for misleading records involving a pipeline. pg&e failed to properly notify regulators about incorrect paperwork that has recently caused safety concerns in that area. the commissioners will now vote on whether to impose a fine. faulty records were found to be a major cause of the pipeline disaster three years ago. the san mateo county elections causes had to reissue 120 ballots. an investigator

determined the ballots mailed were based on old boundaries which have since changed. all the affected voters are being notified by phone and by email. >> all right. 7:17. let's check in with sal. you mentioned something earlier that was interesting. a lot of people leave early on halloween morning so they can get home early. >> we see it every year. been doing this for a long time. i noticed that. people are on the road earlier when it falls on a weekday commute. you can see that in some of the commutes. san jose northbound 280 is jam packed. normally it's not this slow. we've had a couple things helping the slow down on 280. for the most part part-time are on the road earlier. there was a crash with no injuries northbound 280 at saratoga. that was blocking lanes. other freeways that don't have accidents are also slow.

we get 70s and they back off pretty fast. the days are just so short. 70s for many. 60s or 70s. if you are by the bay, 60s or 70s. 60s on the coast south san francisco and low 70s on the peninsula. everything is clear skies. not a worry to be found. warmer into friday. still okay saturday. little bit of a cool down with clouds on sunday. we fall back on the clocks and monday cool and breezy. >> all right. thank you, steve. 7 :21. an 83-year-old woman is behind bars this morning in palm springs on suspicion of stealing a ring from a jewelry store. it's not her first run in with the law. the woman claims she's been an international jewel thief for the past five decades. she has four theft convictions since 2009 in southern california. in 2011 shs she was sentenced to 16

months in prison for stealing a $16,000 ring and was on probation at the time for her latest arrest. >> to say i have no remorse, that's people who don't know me. >> when you see somebody at all, you don't think they are going to steal something from you. >> claims to have stolen millions of dollars worth of joules in the u.s. and europe as posing of a well to do buyer. a movie of her life is reportedly in the works. >> still ahead. we have new information about the shooting of that 13-year-old boy. what the deputy who fired the shot said he could not remember if he did. >> a wave of controversy. why one of the biggest names in surfing says this potentially record breaking ride should not count. ♪

morning that the national security agency monitored telephone calls before and during the conclave where pope francis was chosen. published claims the nsa monitored telephone calls to and from the residence in rome where the future pope stayed. cardinals chose him as pope back in march. the magazine says the nsa also monitored the telephone calls of many bishops and cardinals in the lead up to the conclave. still waiting to learn if he set the new world record with a giant wave he caught off the coast of portugal. the size of the wave is estimated to be 100 feet. still needs to be verified. but a respected name in the surfing world says it doesn't matter how big the wave was because he did not finish the ride. he wiped out. >> in the school i grew up in,

here today and tomorrow. sunshine and warmer temps. cold morning. might be a few patches of fog. so 60s and 70s. some of these are mid 70s. temperatures continue to bump up here. here's sal. >> good morning. we have a lot of traffic out there. some of it is due to crashes. others just the volume here. we're looking at westbound 24. traffic is busy as you drive through lafayette toward oakland. when you get to the bay bridge toll plaza, you will see a jam packed toll plaza before you make it on to the bridge. i do want to mention that north and southbound 101 is a little slow. southbound 101 slowing down as you approach caesar chavez looking for signs of a crash. southbound 101 at 280 there's report there could be something going on. and that's why traffic is beginning to slow down. 7:31. back to the desk . >> thank you. happening today the california

public utilities commission will vote on a plan to overhaul safety rules for workers. in san francisco with the latest on that. good morning. >> reporter: yes i talked to bart about proposed regulations and the agency says it's been on board with this since it first was discussed. we're at the state puc building this morning. if the puc approves this this morning it would be a first for california. this all started in the wake of bart's 2008 worker fatality. the accident that killed two workers earlier this month. here are federal regulations in place. this order today deals with state regulars. and right now those don't exist. there will be a new communication systems within transit agencies and goals moving ahead, that also being

addressed. i talked to bart who gave me this statement. bart has been an active participant. have become increasingly restrictive resulting from the investigation of the accidents that occurred in 2001 and 2008. clearly now this recent accident being incorporated. bart also says it's incorporating the requirements and language of the proposed rules into its rules and procedures that are being revamped because of the accident. the rules don't just stop with communication. they also deal with new technology. wants bart and other agencies to study portable alarm systems. how would those work? basically, a worker would go out on the track and carry some kind of technology with them, set it up on the tracks and that technology could give an alarm. bart told me this morning, it's not that simple. they have a lot of tunnels.

and they don't want to give the workers a false sense of safety. so all that will need to be tested and the puc is hoping if it's tested, something could be in place within about four years. this all being addressed at a puc meeting which starts at 9:30 this morning. ktvu channel 2 news. >> bart says there is no immediate plans to upgrade the machines to take credit cards. thousands of riders who may come up short at that gate use the machines to get out of the bart station. and some riders complain because the machines only take cash or change. in 2005 the machines were upgraded to allow people to use cash to pay for parking. a spokes person says it will cost too much money to upgrade them again to accept credit cards. we have new information about the disappearance and death of a hospital patient at san francisco general hospital. ktvu has learned that today investigators from the california department of public

health will explore the case of lynne spalding. they are going to question five san francisco sheriffs deputies about her disappearance and how her body ended up in a stairwell more than two weeks later. >> 7:34. california school officials say they are surprised by a letter of a federal government that threatens to withhold more than $3.5 billion. california is changing the type of standardized testing it conducts and scheduled to be of transition year. the state does not want to force every student to take both the english and math exams and does not plan to make public the results of the tests that are taken. the federal government says other states have found ways to make changes and still comply with testing laws. new uc president announced she is setting aside $5 million to support students who enter the u.s. illegally. gave her first major address as uc

president last night. some critics have objected to her new role saying undocumented students will feel safe. >> let me be clear. uc welcomes all students who qualify academically whether they are documented or undocumented. >> protestors chanted outside the visit earlier yesterday. inside she encouraged low income students to apply to uc telling them if their families earn under $80,000 a year, they don't pay tuition. >> time now 7:36. new questions about the sonoma county sheriffs deputy who shot and killed 13-year-old andy lopez. told investigators he did not remember if he identified himself as an officer before he shot lopez.

lopez was holding a bb gun that looked like an ak 47 assault rifle. deputies thought it was a real gun and feared for his life. earlier this week told you about massive backlog of weapons. ktvu is there as officers try to reduce that backlog one case at a time. >> you knew you were supposed to turn them over to authorities. >> i have no comment. get that out of my face. >> recently the homes of special agents went door to door. some of the surprising places they found illegally owned guns and what needs to change to clear up that backlog. all part of an exclusive special report tonight at 10:00 news. >> halloween night planes the streets will be packed with trick or treaters and that has

law enforcement agencies stepping up their efforts. joins us live from a spooky looking. >> reporter: good morning. it's finally light outside . but earlier when it was darker, this house was very impressive with all of its glow in the dark spider webs, skeletons, spiders. this avenue is right around the corner from tate. and it attracts a lot of trick or treaters. the homeowners here really do it up. halloween night is expected to be fun. it also can be dangerous. halloween is one of the deadliest holidays of the year on the roadways. the national highway traffic safety administration says the latest statistics show 52% of all national fatalities occurring halloween night involve a drunk driver. on monday a drunk driver was arrested for hitting and killing a woman in san jose. and last week a couple was out

walking their dog when they were struck and killed by an intoxicated driver. is deploying additional patrols today to specifically look for drunk drivers. those we spoke to says safety is on their minds. >> sad we're out enjoying our walk and here comes somebody that could be drinking. that's any time of day. i feel very concerned and make sure the kids are lit up and safe. >> pedestrian injuries are the most common on halloween. recommended to walk in groups. use reflective tape on clothing and carry a flash light. if there is no sidewalk, walk on the side of the road facing traffic. here are safe events going on tonight. there will be trick or treating downtown from 3 to 4:30 p.m. there's going to be a harvest carnival on minnesota avenue from 5:30 to

8:30 p.m. and there will be flash light tours held at win chester mystery house from 6:30 to midnight. and back out here live you are looking at a bunch of spooky decorations here at this home. just one of many in this neighborhood. because it is known for halloween decorations. just spoke to the homeowner inside and he told me they spend like -- they handout 2500 pieces of candy in a matter of three hours. he said he spent a couple hundred dollars on it. reporting live, ktvu, channel 2 news. >> a little bit of money on all those decorations. it looks agreement it is 7:40. a san francisco cab company is offering free rides to make sure people get home safely. luxor cabs is offering the free rides between 10 p.m.

stocks are down in early trading as investors have a mixed bag of earning reports. the profits miss forecast. time warner cable and expediarose.

down 60. and s&p is down 6. keeping an eye on facebook stock today after had a price swing of 17%. right now that stock is down about $1.67 at 48.19. and dropped when facebook's financial chief says younger teens are cutting their daily use of the web site. earlier yesterday facebook stock jumped to $60 when the company reported revenue soared 60% as mobile ads continue to grow. twitter is being sued by two financial firms in the lead up to public offering. the company says twitter asked them to launch a private stock sale but then canceled it. twitter was trying to guarantee stock would sell for at least $19 a share when it goes public next month. asking for $124 million

very chaotic. a man walking down this path was attacked by two other dogs described as pit bulls or pit bull mixes. when it got to the street, that's when neighbors say it got really scary. >> just before 9:00 last night, neighbors heard screams. >> there was like a bunch of cop cars out here and i was scared and i heard gunshots and i ran inside. >> some neighbors ran out of their homes to see what all of the commotion was about. that's when two dogs with a man walking his two dogs attacked them. >> there was blood all on my sidewalk and my driveway. they got close to here. >> four people were bitten. wounds mostly to arm s and legs. >> officers arrived and the dogs charged at the officers and the officers were forced to fire upon the dogs killing one. one of the dogs ran away. >> police captured the other dog when it returned an hour and a half later.

did get the notices. but a lot of them are just hearing the news of a 20-year-old after schoolchild care aid was arrested for inappropriately touching and groping an elementary school girl. police arrested him at his home for kissing and groping that girl. the alleged incident happened on friday october 18th. police say they received a referral from another employee the following incident. and police removed him from any contact with kids. after interviews with the victim, they found probable cause to make an arrest. >> he worked for about 30 days and was a part time employee of the district. was vetted and had been fingerprinted. >> now, the new information we're hearing from the school

district as well as that victim, that student, that school girl is back in class today. she feels safe and did not want to leave school. he was booked. currently out of jail after posting $100,000 bail. also worked at another elementary school in the district. overall he's been with the district for a year. parents were notified yesterday. they met with the school district yesterday to talk about this incident as well. the district and police are continuing to work to see if other kids were impacted by this incident. the arraignment is scheduled for december 5th. live here in san mateo, ktvu, channel 2 news. >> time is 8:06. a man accused of attempted robbery shot and wounded sunday by san francisco police is due in court. 19-year-old novarez is accused of attacking a man.

three times because she has not been medically cleared by the jail. passengers on board a delta flight from tokyo to san francisco finally landed safety last night after making an emergency land nothing a remote part of alaska. the plane was diverted to cold bay airport when the engine warning light started flashing. here is photos of the unscheduled lay over. the pilots acted with caution. the plane carried 167 passengers and 11 crew members. and that's nearly double the population of cold bay where they landed. after a 13 hour wait, a secondary craft arrived to take everyone to sfo. >> dozens of stanford university students are recovering from food poisoning. 40 case ands 4 students are in the hospital. reportedly came sick after eating at the student housing complex. still no word on what may have caused the

rules. checking the puc records in this case. you are back now in san francisco. what do you know? >> reporter: i've been looking over the documents and talking with bart this morning, all about the meeting that gets underway in about an hour. and what happens this morning will be a first for the state of california. we're talking about new rules for transit workers. this started in the wake of bart's 2008 worker fatality. but clearly the accident that killed two workers earlier this month on the minds of the folks here. there are federal regulations in place. this order today deals with state regulations. if all of this passes today, there will be a new communication system within transit agencies that deal with making things safer for workers and also goals for moving ahead. earlier this morning i talked to bart's spoke person saying in part bart has been active and

fully supportive of the rules. governing roadway worker protection have become increasingly restrictive due to added requirements into accidents that occurred in 2001 and 2008. bart said it's already incorporating requirements and language from what's being talked about this monk into effort to revamp rules in the wake of the fatal accident earlier this month. there are things that change in terms of restrictions. talked about the simple approval in the past that was stopped after this accident. they are not going back to that. they are relooking at how to do this. they are talking about how technology could help. want to put portable devices on the tracks so they are out working on the tracks, would alert them to a train. bart says it may take a while to find what works best. may not be conducive to a gps technology and don't want to give workers a false sense of

california is transitioning into a new testing program and the federal government says some of the steps taken violate federal law. and the feds say other states are able to make the transition without violations. state officials say they are working with the federal government to iron out the differences. new uc president announced she is setting aside $5 million to support students who enter the u.s. illegally. gave her first major address as uc president last night. some critics have objected to her new role saying undocumented students will feel unsafe. >> let me be clear. uc welcomes all students who qualify academically whether they are documented or undocumented.

stealing a $22,000 ring from a jewelry store. she was arrested tuesday. and it's not her first arrest. she claims she's been an international jewel thief for the last five decades. she has four convictions since 2009. she was sentenced to 16 months in prison for stealing a $16,000 ring and she was on probation at the time of her latest arrest. >> to say i have no remorse. that's people who don't know me. >> when you see somebody that old, you don't think they are going to steal something from you. >> she claims she stole millions of dollars worth of jewelry in the u.s. and europe by posing as a rich buyer. we're told a movie of her life is in the works. >> it is ten minutes before 9:00. want to check in with sal. how are things looking? >> not that great.
